This article considers the dangerous legal, social and economic situation for both documented and undocumented African LGBTI Refugees & Migrants. The examination is conducted against a backdrop of routine and normalised violence in South Africa, the flagrant impunity enjoyed by rights violators and a dysfunctional refugee application/processing system. The situation is heightened by a continental context that not only accepts discrimination and violence against LGBTI people but also continues to criminalise consensual homosexual conduct.
